LINEA DESIGN Milano S.r.l., as the Data Controller of your personal data, informs you—pursuant to Articles 12 and 13 of Regulation (EU) 2016/679 (General Data Protection Regulation, hereinafter also referred to as the "GDPR")—that your personal data will be processed by specifically authorized individuals and solely for the purposes and in the manner outlined below.

LINEA DESIGN Milano S.r.l. believes in the importance of privacy for all its users and uses the data collected solely to improve the user experience on the Site, in compliance with the standards established by European (GDPR) and national (Privacy Code) regulations, by updating this privacy notice and making it easier to read and understand.

PURPOSE AND OBJECT OF DATA PROCESSING
LINEA DESIGN Milano S.r.l. informs you that it processes your data and collects and/or receives personal information about you, such as personal identification data: name, surname, physical address, nationality, province and municipality of residence, landline and/or mobile phone number, fax, tax code, VAT number, email address(es); and banking data: IBAN and/or bank/postal account number (credit card numbers are not included), in accordance with the purposes and methods defined and specified below.

In particular, the personal data provided to LINEA DESIGN Milano S.r.l. will be processed for the following purposes:

  1. To access and purchase the services and/or content and/or products offered by LINEA DESIGN Milano S.r.l., including through the Site, and in particular with reference to all functionalities enabled by interaction with the Site via specific buttons. Please note that the completion of these purchases may involve redirection to other websites managed by third-party companies, which may be designated as data processors pursuant to Article 28 of the GDPR.
  2. To ensure the proper functioning of the Site and all related technical features, in order to provide users with the best possible browsing and service purchasing experience through the Site.

LINEA DESIGN Milano S.r.l. never sells the Data Subject’s personal data to third parties, nor does it use them for undeclared purposes.

The data may be disclosed to our collaborators and employees, in their capacity as data processors or persons in charge of the processing, as well as to external parties, not only to fulfill legal obligations, but also for purposes auxiliary to the existing economic relationship, within the limits strictly necessary for the performance of their tasks.

Furthermore, for the purposes stated above, the data may be disclosed to the following entities or categories of entities:

  • Transport and shipping companies for activities related to the delivery of goods and customs procedures;
  • Banking institutions for the management of payments and collections;
  • Tax authorities and other public institutions in fulfillment of legal obligations;
  • Competent authorities for the fulfillment of legal duties;
  • Legal firms and law offices for the protection of contractual rights;
  • External companies, accounting firms, professional consultancies, trade associations, for the performance of administrative, fiscal, technical, accounting, and consultancy services.

The provision of data is necessary for the fulfillment of contractual and pre-contractual obligations. Failure to provide such data will result in the inability to properly fulfill contractual obligations.

LINEA DESIGN Milano S.r.l. confirms the use of appropriate security measures to ensure the confidentiality and availability of the personal data received and requires its suppliers, data processors, and third-party consultants to adopt equally adequate and equivalent security measures.

Personal data will in any case be retained by LINEA DESIGN Milano S.r.l. in order to fulfill obligations, such as tax and accounting duties, that continue even after the termination of the contract.

As further detailed below, data subjects have the right to access their personal data, request their rectification, updating, or deletion if incomplete, incorrect, or collected in violation of the law, and to object to their processing for legitimate reasons. Personal data collected on the basis of your optional consent may also be used for the following purposes:

The processing of data provided by the user, including data automatically collected during browsing, will be carried out solely for the purpose of verifying and/or monitoring access to the Site and/or for improving the Site’s functionality, in order to ensure a better browsing experience.

LEGAL BASIS FOR DATA PROCESSING
Except as specifically stated regarding browsing data, the provision of your personal data to LINEA DESIGN Milano S.r.l., as described above, is based on the following lawful grounds for data processing (“legal bases”):

  • Article 6, paragraph 1, letters b) and f) of the GDPR (performance of a contract; legitimate interest), for the purposes outlined in points a. and b. above;
  • Article 6, paragraph 1, letter a) of the GDPR (consent), for the purposes outlined in points i. and ii. above.

The provision of your personal data is therefore considered "necessary" for the full achievement of the purposes mentioned under points a. and b. above. Consequently, your refusal to provide such personal data may result in the inability to perform the related services and functionalities of the website, partially or entirely.

By contrast, the provision of your data is "optional" for the full achievement of the purposes outlined in points i. and ii., and therefore your refusal to provide the data will not affect the performance of the related services and functions of the website, nor will it limit any of its features. We also remind you that, under current regulations, the Data Controller may use the email address you provided during the purchase of a service and/or product and/or editorial offering to propose products, services, and/or offerings similar to those you have already purchased. However, if you do not wish to receive such communications, you may object at any time by notifying the Data Controller, either by writing to the email address provided below or by using the unsubscribe link included in every promotional email you receive. In this case, the Data Controller will immediately stop this activity.

The legal basis for the sending of such promotional communications is the legitimate interest of the Data Controller, pursuant to Article 6, paragraph 1, letter f) of the GDPR.

METHODS OF DATA PROCESSING
The processing of the personal data you have provided is carried out through the operations listed in Article 4, no. 2) of the GDPR, namely:
“collection, recording, organization, storage, consultation, processing, modification, selection, retrieval, comparison, use, interconnection, communication, erasure, and destruction of data.”

The personal data you have provided is processed in an automated form by LINEA DESIGN Milano S.r.l. for the time strictly necessary to achieve the purposes for which it was collected. The processing is carried out using technical and organizational measures designed to prevent data loss, unlawful and/or incorrect use, and unauthorized access, in such a way as to ensure a level of security appropriate to the risk, pursuant to Article 32 of the GDPR. This processing is carried out by specifically authorized individuals in compliance with Article 29 of the GDPR, namely employees and/or collaborators of LINEA DESIGN Milano S.r.l. who are authorized personnel and/or system administrators. These individuals may carry out operations such as consultation, use, processing, comparison, and any other appropriate operation, in compliance with legal provisions aimed at ensuring, among other things, the confidentiality, security, accuracy, updating, and relevance of the data in accordance with the stated purposes and methods.

It is specifically noted that the personal data you have provided will only be processed at the registered office of LINEA DESIGN Milano S.r.l., except as otherwise stated below. The data will therefore not be disclosed, and pursuant to Article 13, paragraph 1, letter (e), it may only be processed by authorized individuals and/or by any external data processors under Article 28 of the GDPR (either individual professionals and/or complex professional associations and/or companies), and/or by entities acting as independent data controllers. Pursuant to the same article, they have the right to request the deletion, anonymization, or blocking of data processed in violation of the law, as well as to object to their processing for legitimate reasons.

DATA RETENTION PERIOD

RIGHTS OF THE DATA SUBJECT (USER)
Right of Access
 under Article 15 of the GDPR and Right of Rectification under Article 16 of the GDPR
As a data subject, under Article 15 of the GDPR, you have the right to obtain confirmation from LINEA DESIGN Milano S.r.l. regarding the existence or non-existence of the processing of personal data concerning you, to access the same, and all the information referred to in Article 15, paragraph 1, letters (a) to (h), by receiving a copy of the data being processed in a structured, commonly used, machine-readable, and interoperable format.
Under Article 16 of the GDPR, you also have the right to request that LINEA DESIGN Milano S.r.l. rectify and/or supplement the data being processed if they are outdated, inaccurate, or incomplete.

Right to Erasure under Article 17 of the GDPR and Right to Restrict Processing under Article 18 of the GDPR
As a data subject, you have the right to request, only in the cases provided for in Article 17, paragraph 1, letters (a) to (f) of the GDPR, the deletion of data concerning you, with the exception of cases specifically provided for in Article 17, paragraph 3.
As a data subject, under Article 18, paragraph 1, letters (a) to (d), of the GDPR, you have the right to request and obtain from LINEA DESIGN Milano S.r.l. the restriction of processing of your personal data, meaning that such data should not undergo further processing and cannot be altered. LINEA DESIGN Milano S.r.l. ensures that the restriction of processing will be implemented using appropriate technical measures to guarantee inaccessibility and immutability.

Right to Data Portability under Article 20 of the GDPR
As a data subject, you have the right to receive, under Article 20 of the GDPR, from LINEA DESIGN S.r.l. your personal data processed by automated means, in a structured, commonly used, machine-readable format, and also the right to transmit such data to another data controller, or, where technically feasible, to have LINEA DESIGN Milano S.r.l. transmit such data directly to another identified data controller.

Right to Object to Processing under Article 21 of the GDPR
You have the right to object at any time for reasons related to your particular situation, to the processing of personal data concerning you under Article 6, paragraph 1, letters € and (f), including profiling based on these provisions. The Data Controller will refrain from further processing the personal data, unless it demonstrates the existence of compelling legitimate grounds for processing that override your interests, rights, and freedoms, or for the establishment, exercise, or defense of a legal claim.
If personal data is processed for direct marketing purposes, the data subject has the right to object at any time to the processing of personal data for such purposes, including profiling to the extent related to such direct marketing.
If the data subject objects to the processing for direct marketing purposes, the personal data will no longer be processed for those purposes.

EXERCISING THE RIGHTS OF THE DATA SUBJECT (USER)
You can exercise the rights listed above by sending a request via email to linea-design-srl@legalmail.it.
LINEA DESIGN Milano S.r.l. will confirm receipt of your request and provide you with information regarding the action taken, concerning the exercise of your rights as outlined in Articles 15 to 22 of the GDPR, within 1 (one) month from the receipt of your request. If necessary, and considering the complexity and number of requests, LINEA DESIGN Milano S.r.l. may extend this deadline by 2 (two) months, provided that a reasoned communication is sent within 1 (one) month from the receipt of the request.

LINEA DESIGN S.r.l. will inform any recipients, as identified in Article 4, paragraph 1, item 9 of the GDPR, to whom the data has been transmitted, of any rectification, erasure, restriction, or objection, unless it proves impossible or involves disproportionate effort.

Following your request for rectification, erasure, restriction, or objection, if LINEA DESIGN Milano S.r.l. has reasonable doubts regarding your identity, it will ask for further information to confirm it. These communications will be sent via email from the aforementioned address and will be processed by the person specifically authorized for this purpose.

Finally, you are reminded that you have the right to lodge a complaint with the Data Protection Authority (Garante per la protezione dei dati personali), as specified under Article 13, paragraph 2, letter (d), and regulated by Articles 77 and following of the GDPR and Articles 141 and following of Legislative Decree 196/2003, as amended by Legislative Decree 101/2018.
